Hitz Imaging
Ltd Terms and Conditions for purchases of Curious Metallics and SKIN
Papers, Card and Envelopes.
By requesting any product or service from Hitz Imaging Ltd, you, the
customer, are bound by the following Terms & Conditions.
Definitions:
"Curious item/s" means Curious Paper, Board, Card and/or Envelopes
in the Metallic and SKIN ranges.
"Customer" means the party who is
contracting with Hitz Imaging Ltd to acquire goods and services
supplied under these Terms & Conditions.
"Website" means the website of this
company - Hitz Imaging Ltd.
"Parcel" means the package containing
the Customer's Curious Paper, Card, Board or Envelopes.
1) Tax: In accordance with British Tax Law
Hitz Imaging Ltd is currently not required to charge VAT on any
product, as a result Hitz Imaging Ltd prices are currently VAT free
on all products. However, we are not responsible for any other tax or import
duties charged to the customer, by any other relevant taxing
authority.
2) Delivery (i):
(Times): Curious Items are generally dispatched within 3
days of cleared payment. Curious Items are always sent either by
Royal Mail First Class Post, or a Next Day Courier. The Customer is
informed as to when the Curious Items have been dispatched and by
what method. Timescales of dispatch and delivery are intended as a
guide only, and is not the essence in any contract with the
Customer.
Delivery (ii) (Royal Mail): Delivery
via Royal Mail will be to the Customer's Letterbox or Mail Box, if
one exists at the delivery address supplied. If no Letterbox or Mail
Box exists at the delivery address, it is the customers
responsibility to arrange an alternative means for the receipt of
Curious Items. Customers will be advised if the parcel containing
the Curious Items is unlikely to fit through a standard Letterbox
or Mail Box. It is the Customer's responsibility to act on this
information to ensure the parcel is safely received.
Delivery (Channel
Islands, Ireland, Overseas):
Will incur an extra delivery fee in addition to the delivery fee
listed in the shopping cart.
4) Damaged Goods: Hitz Imaging Ltd will
never dispatch damaged Curious Items.
Therefore, if a Curious item has been damaged as a result of the
courier service used, the customer must give advice of any damage to
goods in writing, to Hitz Imaging Ltd and the courier company within
3 days of delivery, or in the case of non-delivery, within 10 days
of dispatch.

Unwanted Goods: If a customer has ordered and received any
Curious item, but no longer wants it, the customer may:
(i) Give
notice to Hitz Imaging Ltd of the unwanted items within 7 days of
receipt. The customer will pay the postage costs for returning any
unwanted Curious items. Any unwanted items must be
returned unused and in the original packaging to Hitz Imaging Ltd,
where they may exchange the Curious item for a different item (and pay any difference if applicable, or
be refunded any difference if applicable). After 7 days the Customer
is deemed to have accepted the Curious Items and no refunds are
issued.
(ii)
Alternatively, the customer may return any Curious item, unused,
and in original packaging to Hitz Imaging Ltd, and request a full
refund (less postage costs). The customer must give notice to Hitz
Imaging Ltd of any unwanted Curious item within 7 days of receipt.
The customer will pay the postage costs for returning any unwanted
Curious items to Hitz Imaging Ltd. The money will be refunded to
the customer's original payment method when the Curious item is back within
the possession of Hitz Imaging Ltd. After 7 days the Customer is
deemed to have accepted the Curious Items and no refund will be
issued.
6) Incorrect Order: If, in the unlikely
event, Hitz Imaging Ltd has dispatched an incorrect order to the
customer, the customer may return the unwanted Curious items,
unused and in original packaging, and upon receipt of the unwanted
Curious items Hitz Imaging Ltd will dispatch the corrected
Curious items to the customer. Alternatively, the customer may
request a full refund. Hitz
Imaging Ltd will cover all postage costs, but only in the
case of Hitz Imaging Ltd dispatching the wrong order.
7) Paper/Card/Board Sizes: Unless
requested or stated otherwise, Hitz Imaging Ltd will supply
Curious Paper, Card/Board in A4 size. Customers may request
Curious Paper, Board or Card to be cut or folded to a different
size at the time of ordering.
8) Payment: Hitz Imaging Ltd states
that payment is to be made in full when ordering any Curious
items. Payment can be made securely online via PayPal, Credit or
Debit Card, or Cheque (which must clear before dispatch).
9) Cancellation (i): If the customer
wishes to cancel any order, after paying, but prior to dispatch,
Hitz Imaging Ltd will be entitled to payment for any Curious Item that has been specifically ordered
for the customer if Hitz Imaging Ltd is unable to return the
unwanted Curious items to it's suppliers. If Hitz Imaging Ltd is
able to return the unwanted Curious items to it's suppliers, then
the customer will be entitled to a refund, less any postage costs Hitz Imaging Ltd may incur returning the items back to it's
suppliers. Any money refunded, will be refunded to the customer's
original payment method

Cancellation (ii): If, in the unlikely event Hitz Imaging Ltd
has to cancel a customer order while it is being processed, the
customer will be refunded the money in full to their original method
of payment.
11) Suspended Work: Should any
Curious order be suspended at the request of a customer for a period of 30
days or more, Hitz Imaging Ltd will then be entitled to payment for
the Curious items that have been specially ordered, and any other
additional costs incurred as part of the customer's order.
12) Insolvency: If the customer ceases
to pay it’s debts in the ordinary course of business, or cannot pay
it’s debts as they become due, or being a company, is deemed unable
to pay it’s debts or has a winding-up petition issued against it, or
being a person, commits an act of bankruptcy or has a bankruptcy
petition issued against it, Hitz Imaging Ltd without prejudice will
have the right not to proceed any further with any work for the
customer. Hitz Imaging Ltd reserves the right to charge for any work
already carried out on the customer’s behalf (whether completed or
not), and any materials purchased for the customer, such charge to
be an immediate debt due to Hitz Imaging Ltd.
13) Data Protection: Any details
supplied by the customer to Hitz Imaging Ltd during the ordering
process, shall remain with Hitz Imaging Ltd even after the order has
been completed. Hitz Imaging Ltd will not sell any of the customer’s
information in any form. Hitz Imaging Ltd will have to provide
Customer Details to Courier Companies to arrange delivery of
Curious Items. Hitz Imaging Ltd may use the
customer’s information to occasionally inform the customer of any
new products, services or offers which Hitz Imaging Ltd feel may be
of use or benefit to the customer.
14) Unforeseen Circumstances: Hitz
Imaging Ltd will always make every reasonable effort to complete the
customer’s order by any agreed date or time whether verbally or in
writing. However, Hitz Imaging Ltd will be under no liability if it
is unable to perform any obligation that is owed to the customer due
to circumstances beyond its control. These circumstances include but
are not limited to, Act of God, flood, legislation, war, fire,
terrorism, drought, power supply failure, delivery failure, or a
mechanical failure. During such circumstances, the customer may give
written notice to Hitz Imaging Ltd to terminate any work, and pay
for any work that may have been done, and for materials used, but
subject thereto shall otherwise accept delivery when available.
15) Law: These terms and conditions
shall be governed and construed in accordance with English Law.
English Courts shall have jurisdiction to any matters arising in
connection with any contract formed between Hitz Imaging Ltd and the
customer, or any work carried out by Hitz Imaging Ltd for a
customer, into which these terms and conditions are incorporated. |
