Hitz Imaging
Ltd Terms and Conditions for Unprinted Conqueror and/or Curious Paper, Board, Card
and Envelopes.
These Terms and Conditions are
assessed and modified from time to time. It is the responsibility of
the Customer to read and agree to these Terms and Conditions before
committing to buy any Conqueror Item from Hitz Imaging Ltd.
By requesting any product or service from Hitz Imaging Ltd, you, the
customer, are bound by the following Terms & Conditions.
Definitions:
"Conqueror Item/s" means Conqueror Paper, Board, Card and Envelopes.
"Customer" means the party who is
contracting with Hitz Imaging Ltd to acquire goods and services
supplied under these Terms & Conditions.
"Website" means the website of this
company - Hitz Imaging Ltd - (www.hitzimaging.com).
"Parcel" means the package containing
the Customer's Conqueror Items.
1) Tax: In accordance with British Tax Law
Hitz Imaging Ltd is currently not required to charge VAT on any
product, as a result Hitz Imaging Ltd prices are currently VAT free
on all products. However, we are not responsible for any other tax or import
duties charged to the customer, by any other relevant taxing
authority.
2) Delivery
(i) Timescales of
dispatch and delivery are intended as a guide only, and are not
the essence in any contract with the Customer. If customer orders
are urgent, and needed by a specific date the Customer must inform Hitz
Imaging Ltd of this, in writing, before
paying for any order.
(ii) Delivery of Conqueror
Items will be sent to the address provided by the Customer at the
time of payment. A signature will be required by the Customer on
receipt of the Conqueror Items. It is the responsibility of the
Customer to provide an address where a signature can be obtained,
and Hitz Imaging Ltd accepts no responsibility in a delay or missed
order due to any Customer failing to provide a signature for
whatever reason. In the event of a missed delivery a calling card
will be left which the Customer must respond to within 24 hours.
Delivery (Channel
Islands, Europe, Rest of World):
Customers who wish to place an order
from any area outside the UK Mainland or Northern Ireland will need
to contact Hitz Imaging Ltd before placing any order.
4) Damaged Goods: Hitz Imaging Ltd will
never dispatch damaged Conqueror Items.
Therefore, if a Conqueror Item has been damaged as a result of the
courier service used, the customer must give advice of any damage to
goods in writing, to Hitz Imaging Ltd and the courier company within
3 days of delivery, or in the case of non-delivery, within 10 days
of dispatch.
5)
Returns / Cancellation: The Hitz Imaging Ltd returns policy
is in accordance with the Office of Fair Trading Distance Selling
Regulations (DSR's) and are as follows:
(i)
DSR's do not apply for business to business contracts
(sec2:2). If you are trading as a business, and Customers who
purchase Conqueror Items for any commercial use, Hitz Imaging Ltd will
only exchange Conqueror Items that are defective. If a
business customer orders the wrong item by mistake, the business
customer will not be entitled to a refund, but may re-order
and pay for the correct item.
(ii)
Customer's who are not trading as a business, (but are purely an
individual buying Conqueror Items for non-commercial activity), have 7 working days from receipt
of package to cancel and return the Conqueror Items. The Customer
must provide written notice to Hitz Imaging Ltd within this
time. The Customer must pay for return postage. Under the Distance
Selling Regulations, if the Customer fails to return the Conqueror
Items, Hitz Imaging Ltd will charge the customer the direct cost of
return. Any returns must be complete, in original packaging and
unused. The Customer has a statutory duty to take care of the
Conqueror Items.
(iii)
Under the Distance Selling Regulations the Customer cannot cancel
their order if the Conqueror Items have been made to Customer
specifications. In the case of Hitz Imaging Ltd this means any
Creasing, Cutting, Scoring or Folding to the Conqueror Items that
have been requested by the Customer.
6) Incorrect Order: If, in the unlikely
event, Hitz Imaging Ltd has dispatched an incorrect order to the
Customer, the Customer must give written notice to Hitz Imaging Ltd
within 7 working days from receipt of goods. Beyond this time the
Customer is deemed to have accepted the Conqueror Items. Hitz
Imaging Ltd will either replace the incorrect order within a
reasonable time, or, refund the incorrect order.
7) Incorrect
Quantity: Hitz Imaging Ltd will
always make all reasonable efforts to despatch the correct quantity
of Conqueror Items to the Customer. If however there is shortage,
Hitz Imaging Ltd is entitled to make up the missing amount.
8) Paper/Card/Board Sizes: Unless
requested or stated otherwise, Hitz Imaging Ltd will supply
Conqueror Paper, Card, and Board in A4 size. Customers may request
Conqueror Paper, Board or Card to be cut or folded to a different
size before ordering.
9) Payment: Hitz Imaging Ltd states
that payment is to be made in full when ordering any Conqueror
Items. Payment can be made via PayPal, Credit or
Debit Card, or Cheque. All payments must clear before dispatch.
10) Suspended Work: Should any
Conqueror order be suspended at the request of a customer for a period of 30
days or more, Hitz Imaging Ltd will then be entitled to payment for
the Conqueror Items that have been specially ordered, and any other
additional costs incurred as part of the customer's order.
11) Insolvency: If the customer ceases
to pay it’s debts in the ordinary course of business, or cannot pay
it’s debts as they become due, or being a company, is deemed unable
to pay it’s debts or has a winding-up petition issued against it, or
being a person, commits an act of bankruptcy or has a bankruptcy
petition issued against it, Hitz Imaging Ltd without prejudice will
have the right not to proceed any further with any work for the
customer. Hitz Imaging Ltd reserves the right to charge for any work
already carried out on the customer’s behalf (whether completed or
not), and any materials purchased for the customer, such charge to
be an immediate debt due to Hitz Imaging Ltd.
12) Data Protection: Any details
supplied by the customer to Hitz Imaging Ltd during the ordering
process, shall remain with Hitz Imaging Ltd after the order has
been completed. Hitz Imaging Ltd will not sell any of the customer’s
information in any form. Hitz Imaging Ltd will have to provide some
Customer Details to Courier Companies to arrange delivery of
Conqueror Items.
13) Unforeseen Circumstances: Hitz
Imaging Ltd will always make every reasonable effort to complete the
customer’s order by any agreed date or time whether verbally or in
writing. However, Hitz Imaging Ltd will be under no liability if it
is unable to perform any obligation that is owed to the customer due
to circumstances beyond its control. These circumstances include but
are not limited to, Act of God, flood, legislation, war, fire,
terrorism, drought, power supply failure, delivery failure, or a
mechanical failure. During such circumstances, the customer may give
written notice to Hitz Imaging Ltd to terminate any work, and pay
for any work that may have been done, and for materials used, but
subject thereto shall otherwise accept delivery when available.
14) Law: These terms and conditions
shall be governed and construed in accordance with English Law.
English Courts shall have jurisdiction to any matters arising in
connection with any contract formed between Hitz Imaging Ltd and the
customer, or any work carried out by Hitz Imaging Ltd for a
customer, into which these terms and conditions are incorporated. |
